A federal appeals court judge has overturned a Maryland ban on the use of medical marijuana that was struck down by the state’s highest court last month.
U.S. District Court Judge Margo Brodie on Tuesday struck down the law in favor of six Maryland voters who challenged it in January. In her ruling, she wrote that its intent “to deprive qualified patients or their health care providers of relief from the most debilitating physical or psychiatric symptoms by using marijuana in their medical care should not be upheld.”
Maryland’s voters first banned the use of marijuana for medical purposes back in 2001. But under the U.S. government’s “War on Drugs,” more than 200 states have passed laws legalizing marijuana. Twenty-six of those states allow medical marijuana while nine states have legalized its recreational use.
Marijuana remains illegal under federal law although it has been legalized in 25 states, including Maryland.
