A year ago the U.S. Supreme Court announced that it would not hear a challenge to the Obama administration’s controversial contraception mandate, leaving the door open for the law’s implementation. But in announcing that it was no longer appealing Zubik v. Burwell, the government had also signaled that it wanted to roll back the rule altogether.

The court has repeatedly said the mandate is constitutional. And the administration’s argument that it needs the authority to extend coverage of other services like birth control and sterilization to unmarried individuals is dubious in light of the administration’s interpretation of the mandate.

However, Congress has the power to rewrite or abolish the mandate once it takes effect. It is one of three ways the government can implement the Affordable Care Act. In another, the Department of Health and Human Services could develop a rule or update the mandate so it takes account of new needs that were not addressed in the law, as is typical at the end of a five-year period.

The most obvious problem is why the mandate had to include contraception coverage in the first place. The court ruled that the contraception mandate violates the Affordable Care Act’s individual mandate requiring insurance companies to cover coverage of contraceptives.

Congress could therefore have simply said that insurance companies can no longer require the insertion of emergency contraceptives, or a morning before a daycare session. The individual mandate is, in fact, one of the most popular features of Obamacare, and it covers a lot of services.

But the administration refused to issue such a rule to satisfy the court’s order or to comply with a court order and went to court to take it back. As the court put it, this is “a new level of government regulation.” In the meantime, the administration will continue to do what it has always done under the Affordable Care Act: “To enforce the contraceptive coverage requirement, HHS will continue to promote women’s access to essential health benefits by implementing contraceptive methods that save lives and reduce unintended pregnancies.”

There are some differences between this case and the contraception case that could allow the government to rewrite the law. First, Zubik was not explicitly about contraception. Zubik was about
